If Supposing endeavours used to draw a demarcation line
between the Legislature and the other Departments one course portion
of discourse employed in the endeavour would probably be – the declaration that the Legislature
in the exercise of its power should confine itself to the taking
of entire classes for the subjects subject matter of its ordinance, having
those classes to be filled up by the other authorities departments: that is
to any the designation of the individual, who, when this or that
class as marked out by the law legislation should on each occasion
be understood to belong to that same class or not belong to it,
or in other words that it should not operate of itself and alone and without
the instrumentality of some other authority, operate upon individual
objects or subject matters – whether persons or things,
or at any rate persons, to any such effect as the production
of suffering whether on the account of punishment or
any other accounts.
An application and exemplification of this position doctrine will naturally
be taken to be the case of what in English law language
of English law and then in that of the United States Constitutional Code
is called styled – a Bill of Attainder – for this or that sort of proceeding
which being to all eyes it will naturally enough be said manifestly
unjust is as such held up to abhorrence condemnation by Cicero
when he calls this sort of arrangement a
adding a condemnation in these words.
