When with under the limitations here annexed it is it here said
that the division of power is of no use what is not meant to be
denied is – that in the cases which those publicists had in
view it was of some use more or less use.
But in the first place in those cases the use it
was of were in an extreme degree inadequate to the purpose.
In the next place, in so far as it was of use, it was
no of use than in so far as it tended to the applying
but with a degree of efficiency deplorably inadequate, the power
of which for the same purpose application is made in a direct
and explicit manner: and with the utmost force that belongs
to it namely the power of the Public Opinion Tribunal.
1. That it is altogether greatly inadequate far from adequate to its purpose is manifested
by universal experience. Separated by ordinance, the men
several classes of functionaries are united by corruption, as
above.
2. In so far as it is of use it is by means of the
influence or the that is by the apprehension of the continuance that work department
of the Public Opinion Tribunal that it is of use.
Of this separation, one effect is – publicity – more or
less publicity given to everything that is done: but to establish
publicity is in effect to give establish an appeal and that a
instant one to the Public Opinion Tribunal. This effect
is a sure and constant one.
Another effect is casual and incidental. When
the power is thus decided between different sets disagreement
as to the power that belongs to each is a natural consequence
especially when the demarcation is made in an imperfect
manner as in every instance has been more or less the case.
The more indistinct the demarcation the greater the probability
of such disagreement.
