Constitut. Code
By the Judiciary – that is to say by any Judge before
in whose judicatory a member of the Supreme Constitutive
is prosecuted for the alledged offence committed by the supposed
act of disobedience – by the Judiciary it may be said,
the punishment thus called for may be inflicted.
True, so it may be, but, that it should be is not likely, it is
not likely unlikely were it only for this – namely by Ch.
§. the Judge is made dislocable by the a majority of
the Electors of the District.
True it is – that on this occasion as on any
other it may happen and is likely to happen to the suffrage of the Supreme Constitutive authority
to be divided. But this is an accident inconvenience the
exclusion of which is in the very nature of the man case.
To produce the effect here endeavoured is to produce
by the promptly dislocater applicable power given by Ch. 3. to the Supreme
Constitutive over the members of the Legislative, it is
not necessary that, any application should in fact
be made by it. In any case in which any considerable
probability appears that by the proposed Ordinance
in question the members of the Supreme Constitutive will in
any considerable be likly likely to regard it violative as a
violation of their rights – rights naturally so valuable
in their eyes, the great probability seems to be is that the a majority
of the Legislature will not the enterprize: that
they will not, even though they no considerable apprehension of any
such strong measure as that of dislocating such this unfaithful
Agent, for the by from a degree of unpopularity
much less than that which what would suffice for the dislocation
of the supposed insubordinate functionaries, no inconsiderable
personal inconvenience would naturally be produced or
naturally be produced.
