4. By the authority of the functionaries belonging to the several
other departments namely the Executive including or say the Administrative
and the Judiciary. Manifestly self contradictory and absurd would
be the supposition that by either of those authorities limits ought to
be or could be set to the power of this. Of those institutions the
declared and sole declared end and purpose is the giving execution
and effect to the will formed and declared by the members
of the Legislative. But is it possible that by those or all of
them it should be better known what is the will of the legislative than by the legislative itself?
or, in case of a difference, so well known?
Of both notions therefore namely that of a superiority on the part of an
inferior set of functionaries belonging to the inferior department and that of a superiority on the part
of an anterior set of functionaries in the same department, the
absurdity being palpable to all in important eyes, it can not be
in no other light can it appear other than absurd in the eyes of
those to whose will and consequently in their opinion to whose
interests it is thus adverse, unless it be in virtue of some
ungrounded imagination which it has been the object of the above
observation to dispell.
Those things considered, all endeavour to restrain the
power of the supreme legislature by words of inhibition or restriction
in a Constitutional Code will be seen to be incongruous and
pregnant with evil consequences, and tending to lessen instead of
encreasing the regard paid to it by the authorities and people
of succeeding times.
