Constitut. Code
In regard to restrictions two objects which require to be carefully
distinguished are – 1. the authority by which restraint the restriction
is considered as opposed applied: 2. the sort of acti official
acts – namely ordinances and the result of those ordinances the arrangements
from the issuing of which the functionaries authority in question
is to be may be considered as restrained.
As and for the only authorities by the power of which the pen outline of
the legislator can be, or ought to be considered as being, restrained
that of the people have been mentioned: shall of the people acting in
bodies in the exercise of their authority as members of the Supreme
Constitutive, and that of the people acting separately in their character
of members of the Public Opinion Tribunal.
Now as to As and for the set of acts from the performance exercise of which
by that same it may be right i.e. conducive to the greatest happiness
of the greatest number that they should consider themselves
as restrained.
Of these the general description will be of course be – all
such acts the effect of which will would in the eyes of the persons in
question be detrimental to the interests – to the greatest happiness of the greatest
number.
