Constitut. Code
On this occasion a certain word there is, by which
in virtue consequence of established appointment a special specially-restraining
tie will be apt to be regarded as being applied opposed
to such all such ordinances to it which it is will be regarded as
applicable. The word is Contract and accordingly a question
which on the occasion will naturally present itself is – By
a Contract of any kind entered into by times – by this without
looking for anything further ought is it not right that the legislative
should at all times regard itself as restr bound – restrained
from the issuing of any ordinances by which it could be infringed?
The answer is – by this circumstance no exception can
reasonably be considered as made to the general rules which bear
upon the subject. By no contract ought can the legislature to be
normally considered as a on any occasion restrained from taking the
course which on that same occasion will in his view be
conducive to the greatest happiness of the greatest number: and
again as to authorities, by no contract can any authority
be set up opposite to or other than the authority by which
that of that of the restriction is applied to the authority of the
Legislative in other cases: namely the authority of the people
collectively or separately exercisible as above.
