In regard to all these diversifications thus much may
be said in general terms, that the questi in regard to effects
on happiness the effects of result of the observance or breach
of them the feelings of all the several individuals on both sides are
the feelings that require to be considered: and in regard to
the authority by which the observance is to be considered
as sanctioned it will be in all cases be composed of the
people several members of the Public Opinion Tribunal
members or not of the community in question, in whose
opinion the Legislat members of the Legislature in question
are in their own estimation more or less dependent,
the members namely of the Legislature on whose part breach on the occasion in question or
observance is about to take place.

In regard to all those cases, the way in which by
the entrance into the a contract in question independently of all other circumstances the happiness of
the parties is effected is this. By the entrance into the
contract a new expectation or trace of expectation is on both sides
raised produced brought into existence: by the defect of any such expectation a correspondent
pain of expectation is produced: produced in more or less
intensity in every breath by which the expectation had been
: if then the substitution of breach to observance
be to be justified it must be upon this ground: namely that
by the brea in the new circumstances in which the case is
placed, by the in case of the breach observance of the engagement more pain would
in the breasts of all parties taken together be produced than
would be produced, than by the in the case of breach of it.
