Constitut. Code
In the mode of election or in other words in the source
of location may be seen another objection to the institution
of this clog upon the proceedings of the representatives of
the people. Had this second House been elected by the
same Electors as the first the delay and expence would
have constituted the most material if not the only material
evils. But the Electors Locators are – who – not the members
of the Constitutive body, but a comparatively very small
body not more than 1/35,000th part of those members.
True it is they are functionaries located by those
same locators. But here instead of a location one
stage of suffrages – a location by two stages of suffrages.
Moreover comparison had with the other case the duration in office is in this case treble
what it is in the other.
Here then is a sort of Aristocracy organized: and
in virtue of the double-stage principle an Aristocracy
over which the Members of the Constitutive have no direct
influence: it may indeed be said no influence at all.
Under the here proposed Constitution all other functionaries
are subjected to the dislocative power of the Constitutive.
Under the U.S. Constitution the members of the Senate
are fixt in their situations each of them for no less than 6
years and in all that time neither by the locators of the
first stage nor by the locators of the second stage can they
at nor in a word by any authority whatsoever can they
be dislocated.
Under the U.S. here proposed Constitution not a malefactor
in the whole community not a malefactor in the whole body
of functionaries that is not eventually punishable. Under the U.
