§. Legislative Enquiry Judicatory.

Art. 1. By the a Legislative Enquiry Judicatory, understand
a Judicatory by which evidence is collected for the
purpose of legislation to form a ground for other proceedings
of the Legislature.

Art. 2. Whatsoever be the purpose for which appropriate truth
is endeavoured to be extracted or collected, in the process
best adapted to the extraction of it is the same.

The process here regarded as best adapted
to the purpose of extracting truth for the purpose of judicature
is herein traced out in the Chapters of the which belong
to the Judiciary in this Code, together with those contained
in the Procedure Code: mutatis mutandis it will be pursued
for the purpose of the legislation.

Between the one case and the other whatsoever
differences are made requisite, result from the difference in
respect of extent and thence of importance between the
interests at stake in the one case and those at stake in
the other: and from this circumstance – namely that whereas
in the case of judicature there are as many seats of
action as there are Judicial subdistricts, and thence so many
primary principal seats of enquiry, in the case of Legislature there
is but one: that is to say for the purpose of legislation: both most
in chief and over the whole territory of the State. But the
several Sub-legislatures having each within them, respective territories
the same need of appropriate information and thence of judicial enquiries as the
Legislature over all, hence can so many different seats of
Legislative action, and principal seats of enquiry for the direction of it.
