§. 1. Composition?
Question 1. In the Legislature why not two branches – in English
practice and language two Houses?
Answer. Reasons
1. From more than , say in the first instance disadvantageous even though there be but maleficent Evils
1. Evil effects: dives beneficent good effects, none.
2. Evil effects.
I. Loss of time: – delay between the passing of the project by one
House and the definitive passing of it by both.
In a Constitution which has two Houses, this evil evil in this shape is susceptible
of actual measurement: the Journals of the two Houses will
show
The evil of the day will be composed 1. of all the good produced
by a good law which has been enacted
2. Of the consumption made quantity of time functionaries official time occupied in the Debates
2. Expence to wit of remuneration for the Members of
the second House.
This again in so far as it has place, belongs to the
category list of sensible evils: more plainly sensible than the other.
This however is no place to enlarge upon it: for it is not essential
to the Two House system, if attached to it, attached to it only by accident. Suppose the Second House to
acceptance of all remuneration, in a direct shape way and not to suit
any an one indirect way shape, this evil is extinguished.
