Art. in the For securing of proceeding in this part of those evidence-collecting Judges the Legislature will propose for its intermediate
object of endeavour several persons a person regarded as attached to each
one respectively to so many of the several conflicting interests or some one person regarded
as neutral and indifferent with relation to all conflicting
interests: the supposed neutral person after acting
singly, is as presiding over those who are thus regarded as
partial of the respective interests.
Art. The place or places at which the enquiry will be is
carried on will be that one or those which in each case are
indicated by the joint and antagonizing considerations of the importance of
the object and the delay vexation and expence attached
to the migration and attendance on the part of persons examinees and persons
interested. In relation to one matter of fact the enquiry examination
may have place be performed carried on in one place; in relation to
another, in another. Only for the purpose of confrontation and
the help thereby given to the eliciting of the truth of the case, will
delay vexation and expence be consumed produced indurred employed by bringing
examinees to be brought together into one place from places
mutually remote.
Art. Examples of persons for the exercise
of this branch of the judicial function in this case: Judges Depute permanent
and occasional employed as such in the several Immediate
Judicatories; as per Ch. XI.
