Ch. 6. Aspect of Constitutional law to Penal law
Ch. 6. Provisions of Constitutional Law bearing relation to Penal law. Provisions of Penal law having for their end in view the giving
execution and effect to Constitutional Law
Art. For the endeavour to give aid to a foreign enemy to the
detriment of their own State the punishm penal consequence
shall or may be as follows: namely
1. Personal exposure with appropriate inscription
2. Banishment temporary but renewable 2. Banishment for any time not exceeding a year, re
with imprisonment in such sort as shall be necessary
for carrying the banishment into effect: the banishment
at any time before expiration renewable for the same or any
less time, by a fresh order given issued without fresh trial by the
Judicatory Minister of Justice notified in the Government Newspaper: and so for any successive
number of times
3. Confiscation of property total or partial: for the
time limited, and temporary but renewable authorized as above.
Art. For the endeavour to destroy abolish or change the Constitution
by force, or to displace by force the a functionary or the body
of functionaries in any department the penal consequences shall
or may be the same as for the giving aid to a foreign enemy
to the detriment of this State:
In all other particulars the treatment may be the same as that
given to a foreign enemy: but in no respect more severe.
