Civil Constitut. Code
On the death of a father or widowed mother having
office, in the case of an article a thing of property which is not
susceptible of division without utter destruction of its value
or deterioration so near approaching to destruction as to require
the same provision for the prevention of it, let the thing be
exposed to sale. If there be no bidders, or no bidder beyond
such an amount as to be the to the purpose in
question tantamount to destruction of value, let the thing
instead of being sold be made the subject of a lottery
in which the individuals interested if their shares be equal shall each of
them have a ticket: if unequal, then tickets in a
respectively in number correspondent to the different
quantities of their respective interests.
