§. Jurisdiction settling.

Art. 5. Not for the sake of the functionary but
for the sake of suitors are the powers given to him. To
no one suitor in respect of compensation for injury should
any preference be given at the expence of any other. By
these considerations, will the provisions of the non-penal
and penal codes Procedure included and the acting of Judges the Justice exercise of the judicial functions
and of the Justice Minister in interpretation the application of the law
be regulated guided. As to preference either none at all
will be given to any one class of Creditors demandants at the
expence of any other; or if on any one preference be
given will will not be given but under due adequate notice as both
to as to the made by the law in the belief
and as to the fact of a man's belonging to a
class to which a privilege in this respect has been thought
fit to be given: for which purpose provision will have
been made by appropriate registration and divulgation.

Art. 6. On the one hand, maximization of the
effect of appropriate execution given to the law in each instance; on the other hand minimization
of collateral inconvenience in the shape of delay, vexation
and expence – these are the ends or objects to be
kept in view in the case of the suitors on both sides in any each
suit carried on in any one Judicatory taken singly.

These same will be the ends to be kept in view in any
competition as between the interests interest and interest of suitors in any suit
depending on one Judicatory, and the interest of suitors
in a suit depending on another Judicatory: regard throughout being al
along had to the degree of importance of the suit, in the instance of the
several suits with relation to the interests of the several parties
concerned in it.
