§. 3. Grounds for Appeal

Art. 1. For a Petition of an Appeal presented by a party on either
side from the decrees definitive decrees operative and imperative
of an the Immediate Judicatory the regular and ordinary ground
is constituted by a petition for redress together with a transcript an indication
of the redress prayed, as expressed by the terms of the decrees prayed to be issued
by the Appellate Judicatory and a transcript made of the record of the Immediate Judicatory of the proceedings
operations therein performed and of the instruments therein exhibited
or of such part thereof as in the judgment of the Appellant
is sufficient suffices to authorize the Appellate Judicatory to issue
the decrees prayed.

Art. 2. For this purpose the Appellant, having obtained
leave from the Registrar of the Immediate Judicatory causes to be made a transcript such transcript as
above and having attached by the Registrar: and thereupon forthwith
transmits it to the Registrar of the Appellate Judicatory
by the appropriate conveyance.

Art. 3. If, expressly or virtually the Registrar refuses
the faculty of making taking such transcript, or refuses attestation
to it, such refusal constitutes one of the grounds of and for a
Quasi-Appeal.

Art. 4. Appeal or Quasi Appeal, with the Record – transcript
excepted. No evidence, oral, written or real, which had not
been received or extracted by by the Immediate Judge in the Immediate Judicatory by is receivable
or extractable or receivable by the Appellate Judge. No In
relation to the matter of the suit, for forming a ground for the decrees of the
examination or Appellate Judicatory, no examinational original or recapitulatory
can be taken.
