Constitutional Code
Subject matter.
Art. Misdecision when ante ultimate ante has place in
so far as by any decree antecedent anterior to the ultimate the execution
Art. and effect fail to be given to any such ordinances of the
legislative law as bears upon the subject matter of contestation: in
such sort
Art. 3. That which is On an Appeal the subject
matter of complaint is either Misdecision or Quasi Misdecision
under one or other of those two kinds is every cause reducible injury
capable of being done to a party on either side as such.
Art. Misdecision is either on the occasion of a suit is
either separate ultimate antedefinitive definitive or pos definitive.
Art. Misdecision is where when alternate is where definitive has place
in so far as by the ultimate decrees by which as to everything
but execution a suit receives its termination is terminated, execution and the intended effect
fails to be given to the such ordinances of the law legislature as bear
upon the subject of contestation.
To the head of Quasi Misdecision belongs the
injury in every case in which without actual definitive misdecision by a definitive
decree or pair of decrees, injury to the same effect or for
a time as produced to a party or parties on either side or
to both sides of the suit to the same effect as might have
been produced by in a devil way by misdecision by means
of a correspondent pair of decisions.
