§. Remuneration

Art. 19. Repugnant to the principles of the Constitution
is the collation of a reward in any shape, in any degree
at any time, on the ground of ordinary official service, past,
present or eventually future. Liberality bestowed exercised by a public
functionary at the expence of the public it regards as regarded by it with abhorrence.

Liberality so exercised is but another word for excess is excess
closed in a spurious and deceptious name. Combined In its essence are
comb interwoven breach of trust, punitation, depredation, oppression
corruption and waste. If on any occasion some occasion exercised at a mans own expence
liberality is in virtue, exercised at the expence of others, and
those not it is a vice. As to severity Not to this, but to the opposite
policy does the imputation of severity belong. Indulgence Favour to the few
Sham at the expence of all, favour indulgence to the few is severity to all: good
upon a small scale, evil upon the largest. In this shape folly and vice and
folly are the more dangerous
because by sinister interest and interest begotten
and authority-begotten
prejudice, through the
hand of fallacy clothed
in the garb of wisdom
and virtue.

Art. 20. Repugnant to the principles of this constitution
is remuneration at the public expence in any shape, even for extraordinary
and meritorious shape service in any shape, and
any degree quantity though it be ever so great, if the remuneration
be arbitrarily conferred: and arbitrarily conferred is
such remuneration in every case in which it is not
judicially conferred. As per §. 13 For the manner in which Judicially
conferred it is as per §. 13 even when conferred on the ground of ordinary
service.

Consistently with the principles of this Constitution, arbitrarily that is to say otherwise than judicial can neither good nor evil be made to have place by the
hand of government: neither reward, punishment, nor
exemption from punishment as per Ch. Justice Minister.
