2. Punishment – why
not severer?
A. No imputation
of moral depravity
necessarily attaches.
Of success no chance,
unless the object of the
hostility be such to
a considerable portion
of the whole
citizens.
True, against internal,
government
will of course defend
itself as against external,
adversaries.
But penal means
are not more necessary
in this or than that
case.
Inducements to tenderness
should even
be stronger in this
than that case.
For actual injury
or harm to person,
property, reputation,
or condition in life,
compensation with
or without ultra-punishment,
will
have place in this as
in other cases.
No harm done, no
need of punishment:
by notoriety of endeavour
and miscarriage,
the effect of punishment
will have
been produced.
