aptitude. It
serves as a guide over
the field of the subject
viz.
1. to Legislators
2. To members of the Constitutive,
judges of the
Public Opinion Tribunal
assisting them in passing
judgment on Legislators.

Thus brought to view, two
opposite kinds of engagement: viz.
1. the nebulous or sham
engagement
2. the specific or effective
do.
Not determinate is the
spot at which the one
ends, and the other begins:
only by their object
and their effects
can they be distinguished
in description.
Object of the nebulous,
protecting corruption:
of the specific, the exclusion
of it.

Of all Offices Legislative
and Judicial, are those
as to which it affords the
greatest promise of being
of use.
By the Judicial, it was
first suggested, viz. Ao. 1790,
on occasion of a Draught
of a Judicial Establishment
Code for France,
at the time of the Revolution.

To the people in their character
of Members of the
Constitutive, sole use of
this instrument, ministering
to intellectual aptitude,
as above.
As a do. to moral aptitude,
it is inapplicable to their
case: for
1. Of sinister interest, taken
in the aggregate, they are
not suceptible: to that
end, it will would therefore be
needless.
2. As a curb to sinister
interest, if they had any,
it would be inapplicable:
for in this way, the secresy
in which the conduct
of the voter is carefully
buried, suffices to deprive
it of all binding force.
