Ch. Executive Prime Minister
§. Location.

1.
Question. Why give Location of Supreme
Executive, not to do. Constitutive,
not to do. Legislative?

Answer, Reasons.
I. Why not in Constitutive.
1. As to moral aptitude.
On this point, no reason
can be assigned: no absolute
deficiency: still
less comparative, as
compared with Legislative.

2. As to intellectual aptitude.
Were it only for want
of time, here can not
but be a comparative
deficiency; as in the
case of Constitutive as to
legislative business.

The members of the Legislative
being the creatures
of the Constitutive
the conduct of the Legislative
will in general,
in this particular,
be conformable to
the interest, thence to
the presumable will, of
the Constitutive.

5.
Should it fail of being
so, the case would be
an extraordinary one:
and this case is provided
for by the power of
dislocation given to
Constitutive, applying
both to Executive and to
Legislative.

To the eyes of the Legislative,
all peoceedings
of the Executive being continually
present, they
constantly on the watch
they being the persons by
whom his conduct is
prescribed, by being located
by the Legislative,
he is likely to be kept in
stricter conformity to the interest
of Constitutive, than
if located, on each occasion,
by Constitutive itself.

7.
Materials for judging of
an individual's knowledge
and judgment, on which
his appropriate aptitude
depends, in relation to
their functions, they can
not, the greater bulk of
them, possess, in as adequate
a degree as their
Agents in the Legislative.

Not even antecedently to
experience of the conduct
of the functionary in
question: much less,
subsequently.

9.
For occupying the not
inconveniently disposable
part of Constitutive's time,
suffices the choice and
correspondent examination
of the Legislative;
without adding that of
the Executive.

Included in Executive
are functions in detail
of the due performance
of which, the great bulk
of the members of the Constitutive
are, were it only
by want of time, excluded
from being competent
judges. See Ch.
Executive: and Ch.
Aptitude – tests.

11.
Still, for dislocation of
Executive Chief &c. they
may be competent:
because any malversation
charged on him
will lie within a comparatively
narrow compass.
