Art. 48. For extra service,
analogous to the
ordinary service of any office
in the department, any person
may be considered as if
belonging on its occasion to
that office; and, in proportion
to the value of the
service, be remunerated.

Art. 49. Service which, if
rendered by a functionary
would be ordinary, & requited
by the attached
remuneration, may, if rendered
by a non functionary or
one not in that the situation
in question, be extra
ordinary & as such remunerated.
Art. 50. Examples —
1. Defence of property,
Vessel public or private, or
inhabitant, against enemy
or pirates.
Subdepartment, Army or
Navy.
2. At peril of life, prehension
of a malefactor in the
act.

Examine, lest by confederacy

appropriate service be left
unperformed, that for
performance a nonfunctionary
