Constitutional Code.

§. Subordinates – locable who.

Art. 1. So soon as the proper evidences and tests
of appropriate aptitude, intellectual and active, as
to the several official situations, have been established,
and time sufficient for the attainment of such
aptitude has had place, no person by whom such
evidence has not been exhibited will be locable in
any such situation.

Art. 2. Under the orders of the Legislature, for this
or other purposes, will have been formed and published,
a list of the several subordinate situations,
belonging to the several sub-departments: in this
list, as to such of them of which the local field of
service are fixt, to each situation will be annext
a designation of the place, or places, in which the
service belonging to it is to be performed:

Art. 3. Of these same situations, the aggregate
mass will then be distributed under one or other
of three heads: namely –
1. Situations of talent.
2. Situations of trust.
3. Situations of talent and trust.
