1821. April 20. First Lines Judiciary
Judicial officers functions as above — by who, shall they be
appointed — by whom removable.
Answer. Appointed in every judicatory by one and
the same functionary — the Minister of Justice; removable
by an assembly of the Judicial District composed of the Electors
having votes on the election of a Representative deputed
to the representative body and voting in the same manner.
The appointment will thus be during good behaviour:
evidence of misbehaviour the votes of the majority of the assembly
as above.
Removed by the population of one District, no bar
to appointment in another district. Well or ill grounded,
extensively prevalent disesteem can not fail to be sufficient
cause for removal. But what may happen is, that it is by
appropriate aptitude in one or more or all its shapes that it is — by
integrity and wisdom that temporary disesteem at the hands of a temporarily
prevalent party may have been produced.
The patron functionary from by whom all these functionaries are receive
appointed their appointment why one and no more.
