The Judge, where why removable from his situation
at all, and why by the popular assembly here proposed.
Reason why removable — If not removable, he
will be of course a Despot, sacrificing of course to his
own private and sinister interest, the interests of the
people committed to his charge.
Reason why removable by the majority of the
people committed to his charge?
Answer. Because, in case of misbehaviour, none
have so strong an interest in delivering themselves from the
undue burthens imposed by it; none else have any such adequate
means of clear correct and compleat information in reaction
to it.
Because, in case of good behaviour, none else
have so much any thing to suffer from the loss of the benefits resulting
from it.
Why not give to the people the appointment
in the first instance?
Reason 1. Because, for want of experience, of the behaviour of the individual in that situation
they will be deficient in appropriate aptitude.
Reason 2. Because, in such hands, an operation
of this sort would produce party divisions and undue
and degrading obsequiousness on the part of candidates.
Reason 3. Because for avoidance of partiality and
undue support it is of use that, where other considerations
admitt removal and appointment should be in different
hands.
