To render sufficient reason - or in one word to justify
any departure from that model what, every where two things is necessary: one of them is the dication
of some particular point in which the same system fails
of being productive of that same incontestably beneficial and thence
proportionably desirable effect; the other is - that the in to a
greater extentdegree that same effect is likely to be produced, and
that by in the magnitude of it when supposing it produced will be included adequate compensation
for the uncertainty which is hangs over every undertaking
anticedently to before its time when its real character is placed under the
eyes view of all men by experience or observation, or by both together:
- or say in one word by practice.

Antecedently to the time when the earliest system of arrangements
designated by any such name as government or law
or government came into existence, no every family must in fact have been
in subjection the actions of every other member of it must
have been in fact in a state of subjection to the will of
some one member of it, who by means of this relation it was
constituted the heard of it; within that compass circle the declared
will of that same member was actually productive of the very
effect which is endeavoured to be produced by every thing for the designation
of which the words law and government and law or either of
them are employed in the present state of things.

When, on any such occasion promalgation, and as
an indispensable a necessary preliminary expression came to be given to it, already
it formed in use and practice a system of procedure of Judicial
procedure capable of giving securing execution then thence effect to it.
