Art. 1. In every Judicatory, in all Appellate an Immediate
is a Judiciary Establishment: composed of
there are Offices and Officers Magisterial and Ministerial.

Art. 1. Belonging to every Judiciary are Officers and Offices, Magisterial
and Ministerial. Of the whole collectively is composed the Judicial
Establishment.

Art. 2. The Magisterial Officers are

1. The Judge.
2. The Pursuer General.
3. The Defender General.
4. The Registrar.
5. Their respective Deputes, permanent and occasional. To the
of the
Office of each of these Officers corresponds a line of service in
the Judiciary Department.

Art. 3. The Ministerial are those who, in various ways are occupied
in various ways in the execution of directions given to them respectively giving effect to orders, given emaning from
by the Magisterial Officers, to whom they are respectively
stand subordinate. All Officers Judicat but those here mentioned as Magisterial
are Ministerial.

Article Art. 4. Examples. Of Ministerial Officers examples are as follows —
Examples are 1. Doorkeepers. 2. Scribes. 3. Messengers. 3. Doorkeepers. 4. Seizers 4. Prehensors
of persons. 5. Seizers of land and or goods. 5. 5. Jailors. 6. Executioners
4. Prehensors: namely are 1. of persons; 2. of things immovable;
3. of things moveable. 5. Executioners. Under the authority of a Judge They take possession of
those objects respectively, for the giving execution and effect to the Law,
and to the ordinances of the Judge.

Art. 5. In case of need, for giving effect to the Order of
a Judge, all persons are, on requisition, by him made or from him emaning, bound to act as Minis
occasional Ministerial Officers in any of the above several capacities: all persons, and in particular
all functionaries belonging to the Prevention service functionaries, all Army functionaries
all Military as being of the service, by means
and all Navy functionaries.

Art. 6. So likewise, without the order from a Judge
persons are in certain cases permitted, in certain cases even
bound, to act in those several capacities or some of them, for
the purpose of giving execution and effect to the law: namely
on the presumption that had the occasion come to his
knowledge such would have been the order of the Judge.
