Question 2. Why in every case

Answer. Reasons

Because if in any case a such
affords promises the sort of security in question so does it in every
other case: the nature of things the case advisable not of its drawing
of any line of separation

On the other hand if to the right of appeal no addition
or restriction were applied, a denial of justice would
have place with prejudice of every person by whom the
burthen of delay expence delay and inseparable of it
the application of the remedy can not be endured

Hence on the part of the legislature the necessity of this our endeavour.

1. To minimize the expence delay and vexation attendant
on an appeal

2. So to order matters that when the he who is desirous
of appealing is unable to endure that burthen the necessary relief
from some other operator source, to wit either from the public
or from the adversary shall be afforded to him.

3. That at the , that from no unproceeded appeal
shall net profit in any shape be made by the
appellant
