Ratiocinative.
Arty. 5. Question 2. Why thus in every case: that is to say in
every sort of case:

Answer. — Reasons:—

1. Because, if, in any case such repeated trial and opportunity of investigation in-
investigation affords promises a promise in any degree the sort of security in
question, so in that same degree does it in every other case: between no two cases does the
nature of things the case things admitt not of the drawing
of any line of separation..

2. On the other hand, if, to the right
of appeal no condition or restriction whatever were
applied, a denial of justice would have
place to the prejudice of every person by
whom the expense, delay, and vexation inseparable
from the application of this
remedy cannot be endured. Of the condition requests,
indication will be seen presently.

Hence on the part of the legislature the necessity of using all necessary and practicable endeavours
1. To minimize in every case the expense, delay, and vexation attendant
on appeal.

2. So to order matters, that when he who is desirous
of appealing is unable to endure that burthen
the necessary relief aid shall be afforded to him from some other source, or sources:
relief from some other quarter source, to with from
to act from the purse either of the some voluntary contributor — or contributors, if any should
such come forward, or
if the Judge think fit
of the adverse party,
of which latter it
can not as yet
be known whether
he be in the right
or in the wrong, or
lastly, from of the public
dernier resort, of the public (a)

the public, or from the adversary shall be
afforded

3. That, at the long run, that from no ungrounded
appeal shall not profit, in any shape, be
made by the appellant.
