Ratiocinative
Art. 13. Art. 14. 19. Why with the exception abovementioned,
render the logical fields of all these Judicatories all-comprehensive?
Answer. Reasons
i
i. By any division made, of the sorts of seats, among different
sorts of Judicatories, complication would be established: that
which complication, is altogether needless, is altogether useless, and
would be purely mischievous.
ii
ii. 2. Mischievous it would be in proportion to the
number of fractions into which the logical field were thus
broken: even supposing the limits of them, every one of them, ever so
clearly defin determined and defined described.
iii
iii 3 Adjusting to boundaries between one sort of suit and
another would is in its nature a work of the utmost ,
not capable of being performed with any tolerable degree of accuracy
without a most correct and all comprehensive conception of the whole
field of law and legislation: and, were in that case scarcely
capable of being performed without giving rise to incidents, doubts and disputes, and
thence to suits — in a number indeterminate, and all of them
purely mischievous: with add, to which — jealousies and conflicts of authority
between Judge and Judge: all which conflicts are, by this simplicity
of contrivance, completely obviated.
