Fields of service. Intercommunity of service —
these two Topics require to be considered together.
By the unlimitedness of the logical field of service
within each local field of service — the local field of
service of each Judicatory the complication which, under
all the existing systems, has place in such vast
abundance, and the uncertainty, delay, vexation
and expence which is the fruit of it, stand excluded.
Rational With the single exception of Military Judicatories
no Rational & justificative cause has this complication
in any part of it. Productive Efficient causes this
as well as every as their effect has had, and it is in the history
of
in the state of the political rule of action in periods of comparative barbarism: that the are
to be found: in the conflict between power & power,
and between pretention & pretention among the ruling
few, among whom the aggregate power of the
State was at different times divided. For this history
the present is no proper place. Suffice it to be observed,
that it is not in the greatest happiness principle of Utility — it
is not in any regard for the ends of justice that
the cause of any such partition is to be found.
Among the ends resulting from it, and all the
several evils opposite to the several ends of justice
may be seen resulting from it, the most prominent
and uncontrovertible is the addition to the expence.
Take any local field of judicial service, if in
that local field, supposing no such division of
jurisdiction to have place, establish now a division,
though it were into no more than two logical
fields, each must now have it's judicatory, and
thus the expence of judicial service is double.
