1824. Jany. 7. +
Constitutional Code. Etised

Ch. XII. Judiciary collectively
§.10. Self-suppletive function

1 8

Ratiocinative
Now as to the pay and attendance coupled
together: the closeness of the attendance which it is
supposed will be submitted to, and the moderateness
of the pay which it is supposed will be accepted:
for in regard to probability of acceptance of the situation,
these considerations as they apply to the
situation of the principal who is in possession, so do they to that of the
Depute who is but in expectancy,, and with added force.

The quantum of pay for which, in to a situation
which subjects a man to another's power and at
the same time while it gives him none, a man is content
to give the requisite quantum of attendance. Substitute
a situation in which, to the above elements, power,
such as that of the sort of functionary in question,
is added. Under this arrangement, will pay
in a greater quantity than before, be requisite? No,
says the obvious answer: instead of more being necessary,
even less, if will suffice, unless distinction, power, with chance
of appropriate reputation on an unlimited scale,
be any thing, will be sufficient. are altogether of an un.

But now comes an objection, grounded on
the supposed transcendency and proportionable rarity
of the mass of talent supposed to be here
requisite. Be the number who will be ready to
offer ever so considerable, small, if appropriate
active aptitude, coupled with appropriate intellectual
aptitude in both it's branches is set down as necessary,
will be the number of those on whom it
is fit that the choice should fall.
