S. Judges &c Aid compelling function.
Act 1. Aid compelling function: This function is exercised where
for giving execution & effect to any legislation ordinance through the
medium of the judicial authority, the physical power of the ministerial
subordinate of the judicatory being insufficient or not
at hand a demand has place for such other apistance as the
state of things furnishes
Act 2. of the purposes for which the need of the exercise
of this function may have place, the following are examples.
1. Discovery or pursuit of a latent or fugitive malefactor or other
defendant or proposed defendant.
2. Prehension of one, from whom resistance has been experienced
or is, on adequate grounds, apprehended.
3. Giving termination to a course of conjunct maleficence, carrying
on to the inquiry of person or property; by malefactors
rendered by armatures or numbers, not otherwise subduable.
Act 3. A person whose aid is thus called in, becomes clearly to the
purpose & to the extent of the occasion, constituted as per
SS 3 a
ministerial officer of justice.
Act 4. On every such occasion, as the exercise or non exercise
of this function, as to the number of the pietous or whom the power
attached to it, shall be employed, minimize evil is the rule,
which as on all occasions so on this occasion in particular, will
be to be pursued.
Act 5. Accordingly as to choice of persons, those will be to
be preferred, whose services may be due employed, with
least detriment as well to their individual concerns, as to
the public service, & those of persons specially connected with
them.
