Constitutional Code or Proceedure Code?
Ch. XII Judiciary collectively
§.12. Aid-compellg function
Art. 6. Exceptions excepted, every person of whatever sex
and whatever age is bound to on requisition to give aid
to any functionary for the purpose of and when occupied
in giving execution and effect to any part of the law.
Exceptions are —
1. Where, in making making the requisition the functionary
in question acts in disobedience to the orders or in opposition
to the authority of a sub superordinate superordinate of his.
2. When the act which by him is represented as
being of one which if exercised would be of the number of those which would operate in
giving execution and effect to the law is not in truth
of that number: being on the contrary one not an act of disobedience
to the law.
3. Where the individual so required called upon is restrained by
the consideration of his b or her bodily weakness.
4. Where he or she is restrained by timidity or
say mental weakness.
