1824. March 9. Constitutional Code

Ch XL Judiciary Collectively S. 15. Justice for the poorest

Art. 7. Sources from whence the Equal Justice fund
will or may receive it's supplies, are the following

1. Contributions from all person who, as members
of the Public opinion Tribunal, love of justice, sympathy
for the distressed and injured, or resentment of
oppression, may on the hearing or reading of an in
teresting case, have full disposed to contribute in this way
to the relief of the oppressed.

2. Pecuniary penalties imposed on Delinquents,
in the name and for the purpose of punishment,
in addition to those the producer of which, under the
name of damages, is applied in compensation for
injury: or in lieu of such means of compensations
where the nature of the case affords not any individual
specially injured.

3. In particular, all pecuniary penalties imposed,
in the name of punishment, for the punishment
of insincerity or temerity in litigation. The
burthen having for it's sole object, the diminution of
injurious litigation, by punishing litigants in so far
as and not further than, their conduct as such, is
injurious and blameworthy, will at the end of a
suit, be substituted to that indefinitely
burthen which, under the least had system, is, by factitions
costs, commencing at the outset, and continued
to the conclusion of the suit, imposed without distinction
on the blameworthy authors of injury, and the
blameless sufferers by it.
