II. Juridical false assertion. Juridical
Art. II Juridical vexation is a species of offence to transgression not commissible
but to any considerable extent by any other person than
a party to the suit on one side or other of the suit. False
Juridical false assertion is a transgression into which the a party in
his character of witness, and an extraneous witness, are
equally liable to fall: incidentally also, any other actors of the
different sorts of actors in the juridical theatre.
The Art. Modifications, of juridical
1. Mendacious assertion; 2. insincere assertion; 3. temericious,
or say rash assertion.
As to Mendacious assertion when assertion, under the as yet established
as yet established systems seldom is it made punishable unless it has been under in which the name
of perjury has been
given to it. This

Art. 13. In the application of punishment on this
shape occasion to the repression of the evils, produced by means of an abuse of p the hand of
application made of the hand of justice, no more reserve need be used, than in the application
of it to the repression of evil in the like shape produced
by wrongdoers at large, without the assistance aid of any
such irresistible hand. Of the quantum of the pursuing burthen
imposed on this occasion as yet in all established systems with little or
no discrimination on the made in the first instance between injurers and the injured, namely by factitious costs, a small
portion would in all probability be found sufficient if confined in its application
to the wrongdoers , when offence shows itself in the several delinquency assumes operates in
one or other of the shapes just mentioned.
