Under the existing constitution of England a more prin
approach objection to any such question is would be this: the use of questions
is to cause to be made known that something which would not be known
without it. Now under this same Constitution nothing can be
more or more incontrovertibly known than the
two concerted factorsthe on the part in the several situations of all
public functionaries (excepting a few exceptions to
to be prediction of every effort worth ) exposure to
a seductive and corruptive influence, and the unavoidable
with which such seduction or production of its
effect. Excepting the extremely rare case of a connection
in the way of self-regarding interest or sympathy between
the accused Defendant and the Judge, no one ever expects that in
the case where the King or those in authority under him
have a wish in relation to the suit, the conduct of the Judge
will not be as favorable to that wish as the of the case
admitts it to be. Does not your situation render you suspect
of receiving such and such good things at the hands of his Majesty,
in the event of your rendering your conduct on this occasion conformative
to his Majesty's royal pleasure? Indecorous as
in who does not see that any such question would be to the
last degree nugatory, calling for that as of information which can
not be by any such question be made more notorious
than it is without it.
