Ch. XII Judiciary collectively
(3) 6 §.18 Preinterpretative
Note ( ) continued
In England so immense vast already is the quantity of this excretitious and excrementitious
matter is already so vast that not only the mind
but the pockets of Law practitioners groan under the weight of
it. So intolerable is the pressure that not improbably ere
long something will be attempted in the way of relief. Of relief?
but to whom? to the subject citizen, in whom without the
smallest compunction the burthen presses with all its weight?
Oh never, never. He in whom more than all other persons put
together the application of relief would depend for it applications
swoever could he cut off his right hand that afford than suffer to be afforded at the expence
of their official and professional and oppressors any the smallest particle
of relief to the wretched suffering suitor, to those for whom in practice, against
whom in reality, laws genuine and spurious together have ever been made. The With
the utmost nicety would this be that which was given out under
the name of relief be measured out and weighed, in such sort and so ordered
that that which the relief to the professional man
was maximized. the relief if any to all besides would be
minimized. Here and there a mass of real law condensed:
but every where the mass of sham law left in its existing state
of immensity and ever-encreasing
12. In England so immense
already is the quantity
of the excretitious matter
that not only all hands but
pockets even of Law practitioners
have been ground under it.
13. So intolerable the
pressure, no wonder if
ere long relief were attempted.
Relief? but to
whom? Not to the subject
citizen, on whom the burthen
presses with uncompensated
weight.
14 Some
would be in whose name
than all those together
the relief would depend
cut off his own right hand
then he would permitt
the smallest packet of
relief to reach the suffering
section people: to
those for whom in practice,
against whom in
reality, laws genuine
and spurious. Statute
laws and Common Law
together have with
scarce an exception be
made.
15 To lawyers
official and practitioner
together relief will be
maximized: to all besides
minimized. Here and
there a mass of real
law of legislation made
law, will be condemned.
But the invaluable and
never to be parted with
instrument of despotism
and depredation, the spurious
— the Judge made
law will be left so long
as the classform of government
remains
[+] remains in its present immense and ever encreasing state.
