I §. Conflicting interpretation respecting function §.18.2. eventually-emendative
function §.19.

With whatsoever skill, endeavoured to be excluded, uncertainties, respecting what
on the occasion in question was the desire and will of the Legislator will
in every part of the law, people in a body
be liable to present themselves: To to one man the passage in
question will present to a given individual senses more than one; there is the case of multiples to another
no determinate sense at all: this is the case of obscurity,
as between individual and individual to one the passage one man and another, a passage which presents
no question with to both a determinate sense, will present to the one no sense, to the other a different
and repugnant sense. So Thus it may be, as between individual
and individual before suit commenced so thus it may be as between
individual and individual after suit commenced: so thus it may
be as between either individual and Judge after suit commenced :so thus it
may be between Judge and Judge after suit commenced and
terminated: between Judge Immediate and Judge Appellate
on the occasion of the same suit: between Judge Immediate
and Judge Appellate or between Judge Appellate and Judge Appellate on the occasion of two different suits, in
which have been through the times and places at which they have had place have
been different

having place at different times and places between the two
different parties
the import of the one and the same passage in the law coming in has come
in
question on these different occasions.

Under the existing systems all these doubts, disagreements,
with the uncertainties, conflicts or disappointments which with which they are pregnant
have been and are
in countless multitudes
continually
accumulating, without any thing done for the removal
or diminution of the disastrous mass, under the
here proposed system they will be removed as fast as they
come into existence.

If of the uncertainty in question the cause source
in the opinion of the Judge, his lies purely in a want of
deficiency in respect of discernment or judgment on the
part of a suitor or the suitors, on one or both sides of a
suit actually commenced — all of it in that quarter — none in
any unaptness of expression, it will be a case for the exercise
of his interpretation,
without any exercise given to his eventually
emendative function,
as above described:
