Art. 61 Art. 60 59 By The truth is — that by nothing, but local experience can any adequate
indication be given, of the sufficiency of the as to the requist requisite numbe number of the
Judicatories: and in particular of the number judicatories institutes necessary to be instituted
instituted judicatories in any state; and in particular in any state by which the principles of this
Code may come to be established adopted of the sufficiency of
the number of judicatories, or the sufficiency of the number
of persons persons able and willing in the several judicatories to serve upon
the capacity of the proposed gratuitous terms, in the capacity of Depute, to the Judges and the several other judicial functionaries
Depute. What functionaries. In What this state of things, another state of things the existence of which can not, consistently with any knowledge
of human nature fail to be anticipated, is a general disposition
on the part of those in whom it immediately depends, a general disposition
and endeavour to produce in the number a deficiency
aggregate number of these gratuitously serving Ministers of Justice a deficiency
real or apparent, for the purpose of procuring bringing about an augmentation
in the number of salaried situations of which
the Justice Minister will have the disposal; and to which
the individuals, who dedicate themselves to this branch of
the public service, may aspire: these such are the forces, to
with which on this occasion, the legislature will have to contend.

Art. 6. In The truth As to what is the requisite number of judicatories, —
the truth is that antecedently by experience not in any state, and, in particular,
not in any State, by which the principles of the Code may
come to be adopted, can any adequate assurance indication
be given of that same requis what that number will be. Antecedently to
experience, Alike impossible is it would it be found.
As antecedently to experience to determine
what the number is will be of the persons who was at will, be
able, and at the same time, able and willing &c.
