Ratiocinative

Art. Curious it is to observe how by is the divisive influence with which in the minds of political men of the
highest order in the state of intellectual aptitude this phrase has
operated. Turn to the Federates s. 235 approbation is given to the
institution by which "the members of the Judiciary Department are
to retain these Officers by the firm reason of good behaviour."
This is said not only to be "according to the provision of most of the
Constitution ... as but well as "according to the most reputable and
received opinions on the subject. Again on the same page speaking of the Judges
the meaning the Judges of the time, "the by which they
"now to hold their places is", (says he) "is (says he) it unquestionably
right to be, that of good behaviour."

Art. What he forgets is that in that time Constitution/Government there is
no such alternate not as in that out of which they had made so happily their
escape every such a Monarch from whose distractive
power it was so necessary that the functionaries in
question should be secured, seeing how assuredly it would
be exercised for the adornment of his the Monarchs sinister interest, by and
the sacrifice of that of the people.

Art. Note that, under the here proposed constitution — it not
being a federal one, over all functionaries in question the dislocative
power at by the hands of the Constitution is capable of being
exercised with much less difficulty than under the the d. Constitution.
And this is one among the disadvantageous circumstances attached
to the federal government which however was in their case the
only practicable one.

In the case Of Good behaviour the mode of way to securing its it nature is
not to take for granted the existence not of good behaviour, but
unless excluded by adequate prevention, its opposite. the very opposite of it
