Constitutional Code. 1. Enactive Part.

Art. 12. A vacancy having place in the
situation of Judge whether Immediate or Appellate,
antecedently to the locating of a successor, the
Justice Minister, by letter addressed to the Registrar,
makes known the intended proposed successor, at the Judicatory
in which he is serving has been serving, as likewise, if it
be a different one, in the Judicatory in which he
is intended proposed to be located. In the Judicatory in question Immediately on receipt,
in each of the judicatories, the letter is forthwith in the
proclaimed, and attached to the Service, Table
of that Judicatory, notice is forthwith entered in therein kept, with invitation in writing to all persons so disposed to
the name of the Justice Minister, inviting objections
come forward, and make such objections on as they respectively think fit to make to the intended choice: and to this invitation publicity
is given by all such means as the circumstances of the plan
afford.

Art. 13. From the day on which such proclamation
has been made, the proposed Locatee being
present in the Judicatory in which he has last
served, and the Judge principal, or, in case of
his necessary absence, some other Judge Depute,
taking the judgment seat, any person who has any
objection to make, comes forward in the character
of Pursuer, and the enquiry is conducted on the
same footing, as in the case of a penal suit. In
conclusion Report is thereupon made by the
Registrar to the Justice Minister, who perseveres
in the proposed location, or withdraws it, as to
him seems best most meet.

Art. 16. At the From the very commencement of this Code the test
thus afforded of irreproachableness will be applied. At the commencement
the Justice Minister when he sends to the Judicatory
a 3 probationer sends also to the Judgment seat, along with a person who, during
the probation provides as officiates to that purpose as Judge.
