Art 6. Evils to be guarded against evils through misconduct
on the part of the Judge. 1. partiality undue favor or disfavor
as towards a party on either side: 2. as toward a professional

19
Securities audibility
& visibility

By the system of all comprehensive visib audibility and visibility
added to the arrangements belonging to the judicatory tract of
the Constitutional Code and by in conjunction with the Procedure
Code the security afforded against evil in this shape is regarded
as little less than entire

20
2 In quasi Jury hearings
evil of direct communication
between Judge
& quasi Jury

In Quasi Jury hearing Some assistance to partiality such undue favor some assistance
would be had if the station of the Quasi Jury were so near to
that of the Judge as to afford him the faculty of cajoling them
and by insinuation not heard by the Judicial visitors engaging
them to have unnoticed undue practices of his in relation to the
evidence: such as discontinuing a witness by cutting short his
statements, putting undue interpretations on it, and the like

21
3 Love of Ease

Remains the love of ease. In this shape misconduct
in matters so open to dilution and demonstrable proof, nor by a great deal so odious proved demonstrated and credited
when evident as undue favour. In sinister interest in this shape
the Judge there is scarce a situation in which that of the Judge
may will not have a particular Registrar, Government Advocate, Eleemosynary
Advocate, party on either side, but more especially if in the
wrong, and conscious of being so; party's assistants, professional and
non-professional: all but the in each individual
question; all parties except persons present with the exception of that party or those
parties in the suit, who with reference to that same individual question
whatsoever be the case in regard to other questions: is a believer himself to
be in the right, has an interest which in some instances may be
an effective one in abridging giving to the discussion brevity and
thought it be at the expence of justice: in the discussion — argumentation
as well as elicitation of evidence included.
