1825. Decr. 30
Constitutional Code

Ch. XII Judiciary collectively
2 §. Habitiments
Instructions
I Purposes.

5
Not as a source of
respect — mischief which
would arise if considered
in that character

Art. Not as a source of respect. In this character
a distinguishing habitiment would but either not
operate at all or operate as an instrument of delusion an instrument of factitious dignity
and that delusion mischievous. In this
case as in every other, an enemy to all material
is all factitious dignity, of whatsoever appendages composed:
it operates as a bounty upon, as an encouragement
to, and cause of misbehaviour. Exclude
Keep excluded unapplied all such marks, every man individual is judged
according to his works: Apply those same marks, every
man individual is judged otherwise than according to those same works,
he is judged according to the works looked for at the
hands of all individuals belonging to the same class:
[according to the work looked for rather than according
to the works actually habitually and generally performed.]
[|] for whatsoever be the
quantity of respect preserved by
it or received independently
of good behaviour,
and in spite
of bad behaviour, it
thereby in proportion
to the amount of it
sets a man free from
these restraints which
an individually course
of good behaviour
necessitates, and operates
as a licence for bad
behaviour in whatsoever
shapes he finds most
agreable to him

But for this circumstance
long flowing robes the
most appropriate for

Of all the classes here in question, that of the

such
under a system such as that here proposed any
[such mischievous delusion would in any f very formidable considerable degree
be liable apt to have place] the effects of any such delusion
would be apt to be productive of any considerable mischief.
But for the caution here given, robes being
flowing robes such as among civilized nations have
been in use to those employed would naturally be
allotted to the functionaries belonging to this class the higher
this class: at least to those belonging to the higher grades
