Quere. whether into the Propositions as given in to the commissioner this type
should be included? At any rate it may be inserted into J.B.'s
Edition of them.

§. 35 Habitiments of a Judge

Functionary not
distinguished from others
by his habitiments ought
to be judged of by
his dress

Be the office what it may When in his habitiments the functionary is not distinguished
from any other person he is judged of from his
habitiments, the respect and authority shewn to him is determined
and regulated by his conduct by the conception intertwined of it, by each individual and
thence generally speaking by his dress: when his habitiments
are the effect such as to confer distinction, he is judged of from
his habitiments.

If habitiments such as
to give respect they are
a bounty on misconduct

If then of the habitiments in question the effect is — to
cause respect to be paid to every person by whom they are worn
then so it is that of this same habitiment if not the effect — the
tendency — in a word the more feeling produces is — to operate
as a bounty upon misconduct — upon misconduct in every
shape: for if the treatment a man receives from at the hands of other men
is no worse the same be whatsoever his conduct is may be in regard
to them — whatsoever gratification he gives to himself at their
expence — what is there capable of in that state induces him to to refuse to
himself than some gratification.

habitiments, the greater
the proof of not deserving
respect

These things considered the stronger more strenuous a mans desire
and endeavour is sure to be to preserve unstayed any habitiments
to which by the mechanism of the association of ideas established associat mental association a quality of
respect more or less considerable has to be attended, the more
anxious determined may he without injustice be inclined to be to afford
to himself, wherein occasion and opportunity merits, any such gratification
as chance may have thrown it in his way to procure for himself.
