the functions are judicial

should be exacted.

On this occasion, a the line may require to be drawn
if possible between those cases in which, at the expence of
individuals, compensation for official services ought not on any account, and
those in which, in case of necessity, they it may be afforded imposed
if not without absolute at any rate without comparative
and preponderant inconvenience.

1. A case in which it might not be any the smallest
amount to be then imposed is the case of judication

1 Reason 1. Denial of justice to who have not
wherewithal to pay the tax quantity of money demanded: and

2. The inequality as between those most litigants in casesable to
support the imposition and those least able to support it.

3. The inequality as between those whose good
fortune it has been to remain exempt from the vexation
and expence of litigation, and those who have been sufferers
under it. For from the services of this class of functionaries
those members of the community whose good fortune
it has been to remain unburthened by the vexation
reap that service without burthen on their part the benefit
of all that service which those less fortunate few fellow countrymen
have by this burthen they have been obliged
to take upon themselves such unapt payment.
