Art. 16. To a great
extent, unless the country
be determinate no
determinate provision
can be made.
But where provision
can not be made,
the case may be brought
to view, and the legislator
thus assisted
Unless the contrary be given, these are matters for
which no determinate provision can in the nature of the
case be made. In To the present cases matters the county is
not given, and thence the provision which in all instances as to all matters
is desirable and it is likewise not impossible,
but in the county actual is on various points not possible,
and thence not attempted. But, though the case,
whatever it be, be not capable of being provided for,
by the occupants, no reason is afforded why it should
not be brought to view: the task endeavours of the legislator may
at any rate receive some assistance, and no small quantity
of what would otherwise be his labour, saved.
