§. Uncommissioned prehensive
warrants.

1.
Art. 1. Anglice, any person
seeing a fellony
committed may prehend
and adduce him
to a Justice of the Peace.
But who knows what
a felony is? All it
signifies, and that but
ambiguously, is the punishment,
not the offence.

Art. 2. True in some cases:
of depredation
for instance. But between
depredations
felonious and do. unfelonious,
endless and
generally uncognoscible
are the distinctions.

Art. 3. Within reachable
distance, perhaps
1. There is no such
Justice.
2. Or he is out of the
way.
3. Or he chooses not
to act: for performance
of functions is
not obligatory in the
case of these functionaries.

Art. 4. Under this J.B's Code,
shd. the Headman omit
one day, the next complaint
would go to
the Judicatory, and
the delinquent would
be made to make compensation
for loss of
time &c.

Art. 5. In England, for any such complaint,
complainer wd. be
made to pay £100 or
so for the attempt in
costs before Trial, and
would obtain no redress.
In this only Judicatory,
as well might
the delinquent be Judge
as the Judge. Punishment
none, but on
proof of corruption —
1. As if without it, no
mischievous conduct
could have place —
2. If he has common
sense, existing, it can
not be proved.
3. His station considered,
were his desirous he desirous of
being convicted, the
Judge wd. not suffer
it.
4. He is in a community
of sinister interest
with all the Judges, as
well as Legislature.
