VI. Contract-recording function Purposes Uses in this case
over and above that of Prop as above.

1. Security against dep.

2. Security against injurious alteration

3. Security against fabrication: to wit of evidence of a contract never
in fact entered into.

In all these three cases the topography recording
the [conveyance recording and the contract recording
it will be well worth consideration on how high a degree
the mass of security can not but receive encrease by the diminution
of the delay vexation and expence resulting from
the short length of way between the seat of the evidence and
the abode of the individuals having need to deposit it
and thenceforward of those having need to inspect it
Thus in the case of the conveyance recording function so
in the case of the topography recording function and that of
the topography recording function

To lay down the law relative to these subjects belongs
not to this or any other branch of the Constitutional
Code but to the Non-penal or say Right-conferring and
Procedure Codes. But of whatever arrangements be
which the nature of the case can admitt of in these
Codes the efficiency and preponderant usefulness can not
but depend in no inconsiderable degree on the aptitude
of those which as have regard the functionary under
whose care the operations in question are to be performed
Wheresoever either physical power of performance, or timely
notice of the need of performance are wanting, nullity

the less distant the place
and the more accommodating
the functionaries,
hence more the number
and equality of distribution
of the places

The less the distance of the place of performance from each man's home, and the more constant and accommodating the attendance and accommodating the
department of the functionary, the less that trouble: hence the use of maximizing the number and the equality of distribution in regard to these same places.
