the non federal

the constitutive agreement
4 Difficulty of
expressing such agreement
5 Danger of discord

Art. 5 In so So Exception excepted in no instance
will a Federal constitution be established in preference to a
Non-federal Constitution

Reason 1 Complicatedness of the Federal form. 2. thence difficulty
of giving such the several operations of creation and preservation
in relation to it. 3. Difficulty of effecting an agreement as to the
purport of the mutual/ relation to be established. 3. Difficulty of framing
apt expressions for the designation of these same arrangements.
4. Danger of disagreement and eventual in conclusive mutual hostility but on the
part of the State or confederacy of which is formed or in contemplation
to be formed (mention partialities of D.)

Art. 6 Exception

Art. 6. Exception is where for defence against
a common enemy hostility actual or probable, on the at the hands
hands of another political State too powerful a in such
sort and degree powerful that by no other means resistance
against oppression conquest at the hands of such over powerful State
affords an adequate promise of being effectual

Art. 7. Supposing the existence of necessity in
this shape established, an additional benefit thus an additional
reason is a security against the commencement of hostility as between
State and State, on the part of the States so proposed to
be confederated.

thus the demand for federation ensues where the existence of such overpowering
State exists. Apply this to English powers in Spanish or Portuguese
Americas.
