Art 8 At present it is
doubtful whether any
such demand has place

Art. 8. It does not appear that It seems questionable whether for defence
against a common enemy any preponderant demand for federation has
place at present in any instance.

Art 9 In respect of
security agst hostility,
no clear demand, comparison
had to other means

Art. 9. It does not appear that in respect
of security against host mutual hostility between member
and member of the proposed Federal States any clearly
preponderant demand has place, comparison had with the such
other means as the nature of the case affords.

Art 10 Evils of a
federal constitution in
comparison of separateness

Art. 10. Setting aside for argument' sake these
uses a federal constitution is by several distinguishable evil
rendered inapt in comparison of a separateness:
to wit as between the member and member of the proposed confederacy conf federal government

1. Magnitude of territory
thence of distance & tardiness
of communication
with the central seat of
government

Evil 1 Magnitude of the whole aggregate territory: thence by reason of distance, length
place and time tardiness and unfrequency of communication
between the seat of the central government with its head
offices administrational and judicial on the one part and the
seats of the several particular governments on the other part.

This tardiness more
obvious in the Judiciary
than in the Administrative
Department

Of the distance and consequent tardiness the effects
will be perhaps, be in a more particular degree obvious and striking
in the Judiciary than in the Administrative Department

still constitute a serious
objection & preponderant
objection

Such however the quantity of it would constitute a serious
objection, of sufficient importance weight in some cases perhaps to turn the scale.
